Justice Canceled, Justice Granted.

Image by Freepik T he first time I heard of cancel culture was when I was eavesdropping on my brother. See, he was leading a Bible study group from church, and the topic that night was contemporary issues of the early 2020s in relation to Christian teaching. I wasn’t really interested in what was going on until I overheard things like, "God is the supreme judge" and "Love your neighbor." Then they would proceed to coin terms like "Solomonic wisdom" and "apologetics sickening." From this discussion, I learned that when society forces people with some form of religious authority to take a stand involving a wrong in society, wisdom and apologetics guide that absolute standards may apply to bring those in offense to the book. In my law classes, this is one of the objectives of justice. Making sure people who break the law pay by applying certain principles and standards. Retribution in society brings order, and parties involved are said to be satis

Constitutionality of Anarchy: A Bug or a Feature?

Image
“The state of nature is indeed to be preferred to authoritarianism” ~John Locke-Second Treatise of Government.  Image by Freepik Among the common characteristics of the Uhuru and Ruto regimes is their disregard of the constitution and court orders in a blatant manner! Less than a year into office, Ruto’s regime has already disregarded the constitution with the appointments of his 50 friends to illegal offices. Despite a court order, he went ahead and increased fuel prices. If nothing is done, Kenyans will live to regret feeding a venomous serpent. Its head should have been crushed as early as yesterday. But how and by whom? Thomas Hobbes and John Locke, in their social contract theories, differ in the structure of government. While Hobbes leans towards an absolute leader or monarch, Locke leans towards a limited government through separation of powers, hence checks and balances. For Hobbes, separation of powers would lead to the very thing sought to be avoided: lawlessness, when equ

Let's Protect our Future: Tackling the Issue of Defilement in Kenya

The sad nature of this occurrence is that even after having the Sexual Offences Act of 2006, amongst other laws prohibiting various sexual offenses, there is still a shocker when we look into the rising numbers of sexual offenses, including defilement cases. Such cases are not really evidenced by the mere fact that they have been reported by the victims, but by the fact that we can see the not-seeable scenes of young girls, now young mothers, bearing unwanted pregnancies. Image by Freepik It is clearly noted via an English case, Pugh vs. Pugh, 133 W. Va. 501, 56 S.E.2d 901 (1949 ), that it is not only socially but morally wrong for one to cause one to be legally united in such a union as marriage but also allow such children to engage in carnal knowledge that may lead to their being recognized as child bearers and falling into the traps of such stresses. Defilement is well defined as having carnal knowledge with anyone considered a minor (one under the age of 18). The said offens

"Pity to the man that stands in my way." : A narration

If you are here, then truly time and chance do happen to them all. ❤   Image by Freepik You rub your eyes with the hope of opening the gates for the tears to flow. But they do not. You have tried opening your soul, your heart, your mind, your body... all for nothing. It is still the same, the same thoughts, the same cycle. It never ends. Your friends postpone the sadness till Monday, but you can't. It is ever with you, all through the weekend. You have, however, refused to drown it with a bottle of hooch. It's a  Pity. But hey, at least you feel something, right?  You want to be Unpredictable... You want to be able to do anything on the go, the spontaneous kind of person. But you are still crippled by fear. The other night you wanted to haul at the moon...It was beautiful. There was a jagged line across the sky, and already there was a star, shining pale and cold just over the place where the sun had set. You were careful not to wake anyone while you trudged your way out

I will find Rest

At a Crossroads: Subjective or Objective Morality?

Image
Public opinion, which more often than not appears more nuanced, has sparked surface-level hostility in an already heated sexual orientation debate. On one side, the meritorious, high-minded, and self-proclaimed guardians of morality have adopted the Judeo-Christian approach to argue that recognition of the LGBTQI groups in Kenya will be a catalyst for moral erosion in the country.  On the other hand, liberals have embraced and pushed for LGBTQI group recognition, citing that denying them this right is tantamount to discrimination and persecution. Human dignity, as enshrined under Article 28 of our Kenyan Constitution, has also been invoked by the faction that champions the recognition of this group. These heated debates have consequently translated into gross human rights violations being reported to various human rights organizations both in Kenya and regionally. However, the common rhetoric remains "How should we perceive sex and gender; is there a distinction?" Cracking th

TECH HACKATHONS: INSPIRING INNOVATION

The technological industry is by far the fastest-growing industry in the world. The evolution of technology is characterized by the expansion of human knowledge and understanding. Advancements are also easily adopted, and this is because, due to technology, the world has become a "global village." It only takes a few calls here, some text messages there, a couple articles and video tutorials, and a new concept will have been mastered by the majority of the world’s population within hours of being launched. To develop brilliant concepts, it is vital that a lot of people with different ideas come together and merge their creative thoughts. One way in which this has been made possible is through the organization of tech hackathons. A tech hackathon is an event that is organized to bring together computer and software engineers, as well as other interested people, with the aim of creating a new software program or improving an already existing program within a short period of

Revolutionizing Dispute Resolution: Exploring the Impact of Kenya's New Court-Annexed Mediation Rules

Image
When it comes to resolving legal disputes, the traditional approach has often been to go to court, but that can be an expensive and time-consuming process. Fortunately, there's a better way, and Kenya is leading the way with its new court-annexed mediation rules that promise to revolutionize the way disputes are resolved. As the legal landscape in Kenya continues to evolve, the role of mediation in dispute resolution is becoming increasingly important. The new court-annexed mediation rules 2022, which replace the previous Mediation Practice Rules 2017, represent a major step forward in promoting the use of mediation as an effective means of resolving disputes. These rules not only align with Article 159(2)(c) of the constitution, but they also prioritize access to justice for all citizens. Mediation has long been recognized as a valuable tool for resolving disputes outside of court. It provides parties with a confidential and cost-effective means of reaching a mutually agreeable
